Petitioner, already in custody, seeks bail in connection with Derni P.S. Case No.131 of 2017, registered under Sections 341, 323, 307 and 302/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the only allegation against the petitioner is of giving a single lathi blow at the back of the informant however, there is no allegation of assault to the deceased, the brother of the informant. The allegation of assaulting the deceased is against Harendra Sah and Hewanti Devi and the injury at the back of the informant is simple in nature and the petitioner has clean antecedent. Having considered the said facts and circumstances,
