JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Lakhnaur P.S. Case No. 215 of 2019 registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

One car was intercepted and there was recovery of 5.250 litres of liquor from the said car and petitioner is said to be owner of the car, who succeeded in fleeing away. Submission of learned counsel for the petitioner is that except confessional statement of co-accused there is nothing against him and he has no criminal antecedent. Heard learned APP, who has opposed the prayer for anticipatory bail of the petitioner.

Patna High Court CR. MISC. No.68612 of 2019(2) dt.25-10-2019 2/2 In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. However, if petitioner surrenders and prays for regular bail, the same shall be considered on its own merit, without being prejudiced by this order and, if possible, to be disposed of on the same day.

This application is, accordingly, dismissed.
