Petitioner seeks bail in a case registered for the offences punishable under Section 414 of the Indian Penal Code and Section 25(1-b)a, 26, 35 of the Arms Act. A motorcycle and cash was looted from the passers-by. On getting information, the police was chasing the miscreants. The petitioner and some others were apprehended. From possession of the petitioner Rs.45,000/- cash and a mobile phone was recovered.

Submission is that the said money was of the petitioner as the petitioner was going to buy a buffalo. The petitioner has got no criminal antecedent. Petitioner is in custody

Patna High Court Cr.Misc. No.5274 of 2018 (3) dt.23-03-2018 2/2 since 09.11.2017. He was never put on TI Parade during investigation. Investigation of the case is already complete and the petitioner is ready to cooperate with the trial. Considering the entire facts aforesaid, in my view, the petitioner deserves bail, hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Ramgarh (Nuaon) Police Station Case No. 313 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
