The petitioner has been in custody since 27.11.2017 in connection with Durgawati P.S. Case No. 289 of 2017 for the offence registered under Sections 414/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner rather the petitioner and one person were intercepted on the road and since they were unable to produce the valid papers on the said date, they have been taken into custody. It is further submitted that co-accused Atul Kumar Singh has been extended the privilege of regular bail passed in Cr. Misc. No. 2195 of 2018 vide order date

Patna High Court Cr.Misc. No.6679 of 2018 (3) dt.20-02-2018 08.02.2018.

Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabua in connection with Durgawati P.S. Case No. 289 of 2017.
