2. The petitioner seeks bail in a case registered for the offence under Section 302/34 of the Indian Penal Code.
3. The case of the prosecution, according to the informant, is that on 02.03.2022 at 8:00 A.M. while his tractor was parked in front of his house, petitioner and other accused persons arrived there and started shouting, whereupon the father of the informant came out of his house, whereafter the accused
Patna High Court CR. MISC. No.75359 of 2025(2) dt.13-11-2025 2/3 persons assaulted him by bamboo stick, jack of vehicle and iron rod resulting him being grievously injured and subsequently he died during course of treatment.
4. Learned counsel for the petitioner submits that the allegation of assault is general and omnibus and no specific overt act has been alleged against the petitioner. There is case and counter case. Learned counsel for the petitioner further submits that the petitioner is innocent and has falsely been implicated in the present case due to enmity regarding passage and also local politics. He further submits that similarly situated co-accused persons have already been granted bail by different Co-ordinate Benches of this Court, one of which is order dated 06.02.2023 passed in Cr. Misc. No. 52463 of 2022. The petitioner having clean antecedent is in custody since 20.08.2025. Charge-sheet has been submitted in this case.
5. Learned A.P.P. for the State vehemently opposed the bail petition.
6. Considering the aforesaid facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 5th Bhojpur at Ara in connection with Chandi P.S. Case
