The petitioner is apprehending his arrest in connection with Shyampur Bhataha P.S.Case No.127 of 2018 registered for offences punishable under Sections 185 of M.V. Act and Section 30(a), 237(b) of the Bihar Prohibition and Excise Act, 2016, G.R.No.1066 of 2018.
As per the FIR, there is recovery of 375 ml. Of liquor from the Scorpio vehicle and the petitioner is said to be driver of the vehicle.
Submission of the learned counsel for the petitioner is that the petitoner has taken Barati and he has falsely been implicated . He has nothing to do with the seized articles. Heard learned A.P.P. who has opposed the prayer for bail
Patna High Court CR. MISC. No.68944 of 2019(2) dt.04-11-2019 2/2 on the ground that the recovery is from the vehicle.. Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with direction to the petitioner to surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court and if possible to be disposed of on the same day.
With the aforesaid direction, this application is disposed of.
