The petitioner is seeking regular bail in Madanpur P.S. Case No. 59/2017 registered under Sections 302 & 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that in this case the place of occurrence, as alleged, is not proved. He also prays for calling for the case diary.
In the facts and circumstances of the case where there is a specific allegation attributed to this petitioner for causing assault which resulted in the death of the own brother of this petitioner, I am not inclined to consider either the prayer to call for the case diary or to grant bail as prayed for. The application is dismissed.
