The petitioner has filed the instant application for grant of bail in case a registered for the offence under section 30(a) of the Bihar Prohibition and Excise Act, 2016. As per the allegation in the FIR, about 14 litres of illicit liquor, both IMFL and country liquor are said to have been recovered from an area in front of the house of the petitioner. It is submitted by learned counsel for the petitioner that no recovery as alleged has taken place from the possession of the petitioner. Petitioner is in custody since 28.08.2019 and has no criminal antecedent. It is further submitted that the charge sheet has been submitted in the case.

The application for bail has been opposed by learned APP

Having heard learned counsel for the parties and taking into consideration the above stated facts, the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Patna in connection with Special Case No. 6210 of 2019 arising out of Malsalami P.S. Case No. 262 of 2019 (District Patna).
