JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-11-2019 This application, for grant of anticipatory bail, arises out of Giriyak P.S. Case No. 284 of 2019, disclosing offences under Sections 341, 323, 307, 354, 504, 379, 506 and 34 of the Indian Penal Code.

Allegation against the petitioners is of assault to the informant and his mother by means of spade.

Submission of learned counsel for the petitioners is that there is case and counter case between the parties and impugned order shows that petitioner no. 2 has also sustained injury and further the nature of injury has not been mentioned in the injury report.

Heard learned A.P.P. also.

Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda, Biharsharif, in connection with Giriyak P.S. Case No. 284 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
