The petitioner seeks bail in connection with Bariyarpur P.S. Case No. 105 of 2024 instituted for the offence under Sections 363, 365, 366-A of the Indian Penal Code. 3.
As per prosecution case, allegation against the petitioner is of abducting the daughters of the informant. It is alleged that petitioner had made a call to father of the victim and has told him that he will marry one of his daughters and thereafter, will send back another daughter.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 18-05-2024. Petitioner
Patna High Court CR. MISC. No.78910 of 2024(6) dt.07-04-2025 2/3 bears no criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. It is submitted that victim in their statements recorded under Sections 164 of the Cr.P.C. have not levelled any allegation of overt act against the petitioner. Learned counsel next submits that victims have refused for their medical examinations. Learned counsel submits that there is no ingredients of Section 365 & 366A against the petitioner. Police after completion of investigation has submitted charge sheet in this case.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. It is submitted that victims are minor and the offence levelled against the petitioner is serious in nature.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, there being no allegation against the petitioner even in the statements of the victims under Sections 164 of the Cr.P.C. and charge sheet being submitted, this Court is inclined to grant bail to the petitioner. 8.
Let the petitioner be released on bail on
Patna High Court CR. MISC. No.78910 of 2024(6) dt.07-04-2025 3/3 furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Bariyarpur P.S. Case No. 105 of 2024, subject to the following conditions:
(I) One of the bailors shall be own/close member of the family of the petitioner.
(II) The petitioner shall appear on each and every date fixed at the trial. In case of default in such appearance on two consecutive dates, the Trial Court will have liberty to cancel the bail bonds of the petitioner.
