The petitioner is in custody in connection with Special Case No.148 of 2017, arising out of Didarganj P.S. Case No.159 of 2017, a case under Sections 20/22 of the N.D.P.S. Act, pending in the Court of learned Sessions Judge, Patna. Above 6 Kgs. of Ganja was allegedly recovered from the tempo of which the petitioner was a driver. Petitioner is in custody since 07.10.2017. Petitioner has stated on oath that he has got no criminal antecedent.
Considering the nature of allegation against the petitioner, I am not inclined to enlarge the petitioner on bail for the present. Hence, the prayer for bail is refused. However, the
Patna High Court Cr.Misc. No.5058 of 2018 (3) dt.16-03-2018 P2/ petitioner would be at liberty to renew the prayer for bail, if the trial is not concluded within a year of receipt of a copy of this order before the learned Court-below itself.
