====================================================== CORAM: HONOURABLE MR. JUSTICE SOURENDRA PANDEY ORAL ORDER 08-05-2025 Heard Mr. Vibhakar Kumar, the learned counsel for the petitioner and Mr. Shyam Kumar Singh, the learned Additional Public Prosecutor for the State.

2. The petitioner seeks regular bail in connection with Bihiyan P.S. Case No. 174 of 2024, registered for the offences punishable under Sections 392 of the Indian Penal Code.

3. The prosecution case in brief is that the FIR was lodged by the informant alleging therein that few miscreants snatched away Rs. 5000/- from his pocket, touch screen mobile phone and his Platina bike.

4. Learned counsel for the petitioner submits that the

It has been stated that he is not named in the FIR and his name has surfaced in the statement of one Manish Kumar, who had stated that he had purchased the mobile which was snatched away from the petitioner. The learned counsel further submits that the charge-sheet has already been submitted and the petitioner has one criminal case against him. Lastly, learned counsel for the petitioner submits that he is in custody since 23.07.2024.

5. The Additional Public Prosecutor for the State opposes the prayer for bail and states that the petitioner was party to the loot committed and he also carries criminal antecedent.

Considering the aforesaid submissions made by the respective parties and taking into account the fact that a mobile is said to have been recovered from the petitioner which was subsequently sold to one Manish Kumar and also taking into consideration the fact that petitioner is in custody since 23.07.2024, I am inclined to grant the petitioner privilege of regular bail.

7. Accordingly, the prayer for bail is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two
