JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-11-2019 Petitioners seek bail in anticipation of their arrest in connection with Rajauli P.S. Case No. 162 of 2019 registered for the offences punishable under Sections 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
As per FIR petitioners surrounded the informant and threatened to kill him and there is also allegation of firing against petitioner No.1 which did not hit him and also petitioner No.2 had fired which hit him in his left leg knee and petitioner No.3 also fired which hit him in his left shoulder. Submission of learned counsel for the petitioners is that all the injuries are simple in nature and it could not be
Patna High Court CR. MISC. No.72684 of 2019(2) dt.18-11-2019 2/2 ascertained the injuries caused by firearm or not and moreover the informant is a veteran criminal and he is accused in a case filed by the side of the petitioners and in order to pressurize them the present case has been filed.

In view of above facts and circumstances, let petitioners surrender in the court below within a period of three weeks from the receipt of this order and on surrender they shall be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada, in connection with Rajauli P.S. Case No. 162 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition that they have to co-operate in the investigation and appear before police as and when required.
