JUSTICE BIRENDRA KUMAR ORAL ORDER 07-02-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 304(B), 120 (B) of the Indian Penal Code and Section 3/4 of Dowry Prohibition Act. It appears that earlier prayer for bail was refused to the petitioner on 30.01.2017 in Cr.Misc.No. 53220 of 2016. The petitioner is in custody since 20.09.2016. Prayer was refused with liberty to renew the prayer, if the trial is not concluded within nine months. The report of the Trial Judge would reveal that only one prosecution witness has been examined up-till-now.

In the circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.4542 of 2018 (2) dt.07-02-2018 Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Trial No.19 of 2017 arising out of Kochas Police Station Case No.124 of 2010, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
