The petitioner, already in custody, seeks bail in connection with Karpy (Shahartelpa O.P.) P.S.Case No. 174 of 2017 registered under Section 414 of the Indian penal Code. Allegation in brief is that petitioner was apprehended and found in possession of stolen motorcycle. It is submitted that petitioner is in custody since 31.10.2017. Whereas learned counsel for the State submits that stolen motorcycle was recovered from his possession and he has also criminal antecedent of theft.
Having considered the aforesaid facts and circumstances, presently the prayer of bail of the petitioner is rejected.
Trial court is directed to expedite the trial and
Patna High Court Cr.Misc. No.11596 of 2018(3) dt.10-04-2018 2/2 conclude the same preferably within six months. If trial is not concluded within the stipulated period, petitioner may renew his prayer of bail.
