The petitioner seeks bail in Kazimohammadpur P.S. Case No.150 of 2016 registered under Sections 395 and 412 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. The name of the petitioner figured in the case in the confessional statement of Mantu Kumar Singh. Mantu Kumar Singh also disclosed the name of the son of Dayanand Prasad Gupta and disclosed that he handed over Rs. 9 lac to the son of Dayanand Prasad Gupta. The house of Dayanand Prasad Gupta was searched and Rs. 5 lac was recovered from the house with the slip of Axis Bank. In pursuance of the confessional

Patna High Court Cr.Misc. No.5450 of 2018 (3) dt.18-04-2018 2/2 statement made by Mantu Kumar Singh, the house of the petitioner was also searched and Rs. 3, 32, 000/- with the slip of Axis Bank was recovered. Learned counsel for the petitioner submits that co-accused Dayanand Prasad Gupta, Mantu Kumar Singh, Mahesh Kumar Patel @ Kaliya @ Kaliy and Ranjit Kumar have already been granted bail by different Benches of this Court vide order dated 27.02.2018 passed in Cr. Misc. No.11422 of 2018 and vide order dated 17.01.2018 passed in Cr. Misc. No.44296 of 2017 respectively. The case of the petitioner also stands on the same footing. The petitioner is in custody since 06.05.2016.

Considering the aforesaid facts that similarly situated other co-accused persons have already been granted bail and the petitioner is in custody for about two years, the petitioner above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-cum-Sub Judge-I, Muzaffarpur, in connection with Kazimohammadpur P.S. Case No.150/2016.
