The petitioner seeks bail in anticipation of his arrest in connection with Sasaram (Darigaon) P. S. Case No. 356 of 2019 dated 28.04.2019 instituted for the offences under Sections 420, 467, 468 and 406 of the Indian Penal Code.

The accusation in the F.I.R. is that the informant and many others had deposited money in LIC through the agency of the petitioner but the money was not returned and on being accosted, the petitioner is

Learned counsel for the petitioner submits that the case has been lodged by the informant in a representative capacity, without providing any detail of the investment by either him or anyone of the persons who have been named in the F.I.R.

Apart from this, it has been submitted that F.I.R. is misleading as money has not been invested by the petitioner and his associates in LIC but in Alchemist Group of Companies of which the petitioner is one of the Executives. The amount which has been deposited by the informant and others has been invested in a long term saving with a lock-in period of 16 years. Since the informant and his associates wanted to break the aforesaid deposit and withdraw the money, which was not permitted, the subject F.I.R. has been instituted. Because of the vagueness of the allegation in

The petition is allowed.

The petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (Darigaon) P. S. Case No. 356 of 2019, subject to the conditions as laid down under Section 438
