The petitioner apprehends his arrest in Mahila P.S. Case No. 40 of 2021 registered for the offences punishable under Sections 376(D.A) of the I.P.C. and Sections 4, 6 and 10 of the POCSO Act pending in the Court of learned 6th Additional Sessions Judge-cum-Special Judge POCSO, Motihari, East Champaran.

After some arguments, learned counsel for the petitioner seeks permission to withdraw this application. Permission is granted.

Accordingly, the instant application is dismissed as withdrawn. However, if the petitioner surrenders before the learned Court below within a period of six weeks from today

Patna High Court CR. MISC. No.1192 of 2023(2) dt.23-03-2023 2/2 and seeks regular bail, the learned Court below would pass the order, preferably, on the same day, without being prejudiced by this order.
