The petitioner seeks bail in connection with Sour Bazar P.S. Case no. 599 of 2017 registered under Section 30(a) of the Bihar Excise and Prohibition Act 2016.
1085.760 lts. of Nepali liquor is said to have been recovered from the Bolero pick-up van and petitioner who was standing on the go-down was apprehended.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. Petitioner does not happen to be owner of the said van rather the said van is hailing to his son. He has also no concern with the seized liquor. When he was standing on the
Patna High Court Cr.Misc. No.9220 of 2018(2) dt.19-02-2018 2/2 door of his go-down where the said van was parked, the police arrested the petitioner and falsely implicated in the case. Petitioner is aged about 70 years and has no criminal antecedent. He has no concern with any business of his son. He has been languishing in custody since 21.21.2017. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. 2nd -cum-Spl. Judge, Excise Act, Saharsa in connection with Sour Bazar P.S. Case no. 599 of 2017.
