Petitioner, already in custody, seeks bail in connection with Chiraiya P. S. Case No. 391 of 2017, registered under Section 30 (A) of the Bihar Prohibition and Excise Act, 2016. The allegation in brief is that 52 bottles of Nepali Saufi of illicit wine was recovered from the house of the petitioner. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case due to refusal for giving grocery to the choukidar on credit. It is further alleged that the petitioner has clean antecedent and petitioner is in custody since 14.12.2017.

No.4921 of 2018 (2) dt.31-01-2018 2/2 Having considered the said facts and circumstances, the petitioner, Jitendra Patel, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- ( Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional sessions Judge- VII-cum-Special Judge, excise, East Champaran at Motihari in connection with Chiraiya P.S.Case No. 391 of 2017.
