Petitioner, already in custody, seeks bail in connection with Itarhi P.S. Case No.240 of 2017, registered under Sections 302/34 of the Indian Penal Code as well as under Section 27 of the Arms Act.
Allegation in brief is that when the deceased was going on motorcycle, he was intercepted by the accused persons and on exhortation of the petitioner and one Ritesh Singh, Jitendra Singh shot at Vinod Singh and thereafter Rajendra Singh again shot at the deceased. The occurrence is said to have been committed due to land dispute.
Learned counsel for the petitioner submits that due to land dispute the petitioner has falsely been implicated, he is above 60
Patna High Court Cr.Misc. No.10544 of 2018(2) dt.22-02-2018 2/2 years of age, the petitioner is said to be the order giver but there is no allegation against him of shooting at the deceased. Having considered the said facts and circumstances, petitioner Lalan Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Buxar in connection with Itarhi P.S.
