Heard learned counsel for the petitioner and learned APP along with learned Central Government counsel, Ms. Shail Kumari.

The petitioner seeks bail in a case registered for the offences punishable under Sections 8(c) read with 20(b)(ii)(C), 25 and 29 of NDPS Act.

The learned Central Government counsel, at the outset, submits that earlier the bail application of the petitioner was rejected by order dated 25-5-2022 in Cr. Misc. No. 1353 of 2022, on the ground that during the course of investigation, it transpired that from the mobile number of the wife of the petitioner, the persons involved in the occurrence were

Patna High Court CR. MISC. No.79856 of 2023(2) dt.15-12-2023 2/2 contacted not once but several times, as has been recorded in the said order. It is next submitted that no new material has come, based on which petitioner can be released on regular bail. 4.

The learned counsel for the petitioner submits that charges have been framed.

The court expects that the learned trial court shall expedite the trial.

It is made clear that the official witnesses, as and when required by the learned trial court, must present themselves, failing which it would be construed that the prosecution is not interested in pursuing the case diligently. 7.

The bail application is rejected.
