The petitioner seeks bail in connection with Ahiyapur Police Station Case No.942 of 2019 registered under Sections 447, 341, 323, 307 and 379/34 of the Indian Penal Code besides Section 27 of the Arms Act.

The accusation is that in the evening of 07.08.2019, the informant along with his family members was present at his door and talking to each other. At that time, Saroj Singh along with his elder son came there and made query to the informant about his younger son Sonu Kumar. When the informant made query to them about asking his son, then Rahul Kumar alias Lathi and Ravi Kumar (petitioner) along with 5-7 unknown came there and started to commit "Maar-Peet" with them. In that course, Saroj Singh and his elder son snatched the gold chain and ring of Parwati Devi, the wife

Patna High Court CR. MISC. No.68805 of 2019(3) dt.25-02-2020 2/2 of the informant, and also snatched the gold chain and Rs.69000/- from Chandan Kumar, the elder son of the informant. At that time, this petitioner started to make firing through pistol and gave order to others to kill them. Thereafter, Rahul Kumar alias Lathi shot fire at Sonu Kumar, the younger son of the informant, who fell down there. On hearing the sound of firing, when the villagers reached there, then all fled away from there. Thereafter, the son of the informant was rushed to the hospital for treatment at S.K.M.C.H. Learned counsel appearing on behalf of the petitioner submits that while the petitioner is named in the F.I.R. with the allegation to make firing but the firing of Rahul Kumar alias Lathi hit Sonu Kumar, the younger son of the informant.

The petitioner having no criminal antecedent is in custody since 09.08.2019. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur, in connection with Ahiyapur Police Station Case No.942 of 2019.
