Petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. The FIR of the occurrence of robbery is against unknown. The petitioner was implicated in this case on the basis of confessional statement of co-accused, namely, Kundan Kumar. Petitioner is in custody since 18.12.2017.
Submission of the learned counsel for the petitioner is that the petitioner was never put on TI Parade nor anything was recovered from his possession. Petitioner has stated on oath that he has got no criminal antecedent. Moreover, the investigation of the case is already complete against the petitioner and he is ready to cooperate with the trial.
Patna High Court Cr.Misc. No.21838 of 2018 (2) dt.18-04-2018 2/2 Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Rajoun Police Station Case No. 579 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
