Petitioner, already in custody, seeks bail in connection with Dumariyaghat P.S. Case No.156 of 2017, registered under Sections 272, 273, 34 of the Indian Penal Code as well as under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner contends that the petitioner is the driver of the car and the alleged recovery is approximately 202 liters of foreign liquor, however, the petitioner has no criminal antecedent and he is in custody since 01.12.2017.

Having considered the said facts and circumstances, petitioner Sandip Kumar @ Sandeep Kumar is directed to be

Patna High Court Cr.Misc. No.4762 of 2018(2) dt.31-01-2018 2/2 released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, East Champaran, Motihari in connection with Dumariyaghat P.S. Case No.156 of 2017.
