====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 24-10-2019 Heard learned counsel for the petitioner and learned counsel for the informant.

The petitioner seeks bail in a case for the offence registered under Sections 304(B)/34 of the IPC. The prosecution story, in brief, is that the petitioner and others killed the daughter of the informant due to nonfulfilment of demand of dowry by administering her poison. It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 19.08.2019. The petitioner has got no criminal antecedent. The petitioner has falsely been implicated in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. A petition has been filed by the informant in the

Patna High Court CR. MISC. No.68014 of 2019(2) dt.24-10-2019 2/2 learned court below where he has retracted from his earlier statement made in the F.I.R. The deceased is said to have died due to prolong illness. The said petition filed by the informant is Annexure-3 to the present application.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- VI, Dhaka, Motihari, East Champaran, in connection with Chiraiya P.S. Case No. 182 of 2016.
