The petitioner apprehends his arrest in connection with Bhagwanpur P.S. Case No. 153/2019 registered for the offence punishable under Sections 30(A) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the allegation against the petitioner is that five liters of illicit liquor was allegedly seized from the house, but the petitioner not being present, it was not from his conscious possession. Learned counsel for the petitioner further submits that the petitioner is not having any criminal antecedent.

Considering the aforementioned facts and

No.68394 of 2019(2) dt.27-11-2019 2/2 circumstances, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge, IVth Cum Special Judge (Excise Act), Kaimur at Bhabua, in connection with Bhagwanpur P.S. Case No. 153/2019, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
