The petitioners apprehend their arrest in connection with Complaint CaseNo.513 of 2016 corresponding to Trial No.2651 of 2017 registered under Section 498A of the Indian Penal Code and 3⁄4 of the Dowry Prohibition Act.
The learned counsel for the petitioner submits that the complainant made false and frivolous allegation of demand of dowry and torture against the petitioner. The petitioners aremother-in-law, brother-in-law and married sister-in-law of the complainant. The complainant also lodged Buniyadganj P.S.
Patna High Court Cr.Misc. No.5309 of 2018 (2) dt.02-02-2018 2/2 No.82 of 2016 against her husband and others in which the petitioners are on anticipatory bail.
The learned counsel for the complainant, however, opposed the prayer for anticipatory bail.
Considering the facts aforesaid and the fact that the petitioners are in-laws of the complainant, the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from the date of receipt / production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Gaya in connection with Complaint Case No.513 of 2016 corresponding to Trial No.2651 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
