The petitioner is accused in connection with Special Case No. 9112 of 2017, arising out of Fatuha P.S. Case No. 557 of 2017, registered under Section 120(B) of the Indian Penal Code and Section 30(A)/38 of the Bihar Prohibition and Excise Act, 2016.

The accusation is of recovery of 66 bottles, each containing 375 ML of India made foreign liquor to the house of the petitioner.

Learned counsel for the petitioner submits that the alleged liquor was not recovered from the possession of the petitioner rather the same was recovered from his house. The petitioner is

Patna High Court Cr.Misc. No.17026 of 2018(2) dt.29-03-2018 2/2 in custody since 10.12.2017.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge (Excise), Patna in connection with Fatuha P.S. Case No. 557 of 2017.
