The petitioner apprehends his arrest in Chanpatiya (Sirisiya) P.S. case No. 232 of 2019 registered under Section 272, 273, 414 of the IPC and u/s 30(A), 30(B) of the Bihar Prohibition & Excise Act.

The police intercepted a motor cycle and arrested Bhuteli Ram. Bhuteli Rai is said to have disclosed the name of Chandrika Ram and Vicky Ram, the petitioner, who managed to flee away. Bhuteli Ram further disclosed that owner of the motor cycle is the petitioner and the motor cycle appears to have stolen one.

The learned counsel for the petitioner submits that petitioner has got enmity with Bhuteli Ram from before and there is absolutely no material against the petitioner that

Patna High Court CR. MISC. No.68337 of 2019(2) dt.11-12-2019 2/2 petitioner cooperated Bhuteli Ram in transporting the liquor. The petitioner is not the owner of the vehicle and he has no manner of concern with the vehicle.

Taking into consideration the facts that save and except disclosure made by Bhuteli Ram there appears no material against the petitioner, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bettiah, West Champaran in connection with Chanpatiya (Sirisiya) P.S. case No. 232 of 2019, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
