The petitioner, who is in custody since 20.08.2019, seeks bail in connection with Mokama P.S. Case No. 148 of 2018 which has been instituted for the offence under Sections 341, 323, 504, 326, 379 and 34 of the Indian Penal Code.

It has been alleged in the FIR that on the pretext of returning the money of the informant, the petitioner took him to his house and on the way assaulted him. The petitioner is said to have been helped by his brothers. The petitioner is also said to have given two knife blows in the

The learned counsel for the petitioner has submitted that the injury report supplied by the Government hospital does not indicate any injury inflicted by knife. However, the private hospital has given a certificate that there are knife injuries to the informant and the deceased and there is laceration of the liver.

Considering the period of custody of the petitioner and the background facts of there being dispute with respect to payment of loan and the clean antecedent of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-4th Barh, District Patna in connection with Mokama P.S.
