The petitioner, who is in custody, seeks bail in connection with Jehanabad (Kalpa O.P.) P.S. Case No. 172 of 2015 registered for the offence punishable under Sections 147, 148, 149, 341, 427, 379, 387 and 506 of the Indian Penal Code. Informant in his written report has stated that he alongwith his brother Md. Tamjeet had been working in the new under construction Building of High School, Dhuriya under the contractor. It has been further alleged that on 23.04.2015 at about 11-12 in the night six persons came at the site of construction and told them to stop work by giving threats. All
Patna High Court Cr.Misc. No.16665 of 2018(3) dt.13-04-2018 2/2 persons were armed with deadly weapons and one person was armed with danda. They smashed the bamboo of roof of school and snatched their mobile and told them to send money by their contractor.
Learned counsel for the petitioner submitted that he is not named in the FIR .It has been further submitted that petitioner is quite innocent and has been falsely implicated in this case. No incriminating material has been recovered from possession of the petitioner and no T.I. parade has been done. It has further been submitted that petitioner is in custody since 01.05.2017.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Jehanabad, in connection with Jehanabad (Kalpa O.P.) P.S. Case No. 172 of 2015.
