2. In the present case, the petitioner seeks bail in connection with Jiradei P.S. Case No. 106 of 2025, registered for the alleged offences under Sections 126 (2), 115, 118, 109, 74, 352, 351 (2), 3 (5) of BNS, 2023.

3. As per prosecution case, the petitioner in inebriated condition came to the doors of the informant and started misbehaving with his son. When the informant went to make him understand the situation, the co-accused persons came there and this petitioner stabbed the informant on her head with knife.

4. The learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. There is case and counter case between the parties and

Patna High Court CR. MISC. No.74391 of 2025(2) dt.20-11-2025 2/3 injury has been received by both the sides. The counter case of the petitioner is Jiradei P.S. Case No. 107/2025. The real fact behind the occurrence is that marriage of the wife of the petitioner was firstly finalized with the informant's son, but ultimately, she got married to the petitioner and due to this enmity, the informant has falsely implicated the petitioner in this case. The injury report of victim Geeta Devi falsifies the allegation against the petitioner as it was alleged that the petitioner assaulted her with knife, but the injury report shows Geeta Devi received injury caused by hard and blunt substance. The petitioner is in custody since 23.08.2025 and is having clean antecedent.

5. Learned APP vehemently opposes the submission made on behalf the petitioner.

Having regard to the facts and circumstances and submission made on behalf of the parties and considering the case and counter case of the parties and further considering the absence of injury on the victim attributed to the petitioner and also considering the period of custody of the petitioner, he is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1,

Case No. 106 of 2025, subject to the conditions mentioned in Section 480 (3) of BNSS and also the following conditions : (i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
