JUSTICE BIRENDRA KUMAR ORAL ORDER 21-02-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-B), A, 25(1-A), A, 25(1-C), A, 26(1)(2)(3), 35 of the Arms Act. The petitioner is in custody since 16.09.2016.

Submission is that nothing was recovered from possession of the petitioner, as submitted by the learned counsel for the petitioner. Petitioner was never put on T.I.Parade. Only material is confessional statement of coaccused and criminal antecedent of the petitioner disclosed in paragraph-3 of the bail petition.

Considering the nature of allegation and the

No.10220 of 2018 (2) dt.21-02-2018 period already undergone by the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S.T.No.270 of 2016 arising out of Kotwali Police Station Case No.275 of 2006, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
