====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 03-12-2025 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State.

2. This application for grant of anticipatory bail, arises out of Suryapur Police Station Case No. 126 of 2025, disclosing offences under Sections 191(2), 190, 126(2), 115(2), 109, 303(2), 351(2), 352 of Bharatiya Nyaya Sanhita, 2023.

3. The prosecution case, as per the First Information Report is that on 23.04.2025, in the evening when the informant came out of her house and saw that

Patna High Court CR. MISC. No.74433 of 2025(2) dt.03-12-2025 2/3 petitioners along with other accused persons were opening the window, near the land, falling in the share of her husband. When the informant protested, the petitioner no. 2 exhorted the other accused to kill the informant. Upon which Pramod Kumar Singh i.e. petitioner no. 1 fired from his gun upon the informant. Petitioner no. 3 snatched golden chain from the informant.

4. Learned Counsel for the petitioners submits that both the parties are agnates having previous enmity relating to partition of ancestral property. The allegation against petitioner no. 2 as an order giver and there is no sign of firearm injury upon the informant as would be evident from the injury report which is annexed at Annexure-3. The allegation of firing is upon petitioner no. 1. The allegation against petitioner no. 3 of snatching the golden chain is motivated and ornamental. A counter case has been lodged by the side of the petitioner against the informant and others bearing Suryapur P.S. Case No. 125 of 2025.

5. Having considered the rival submissions made by the parties and considering the fact that victim is having no firearm injury and petitioner no. 2 is an order giver, I am

6. This application is, accordingly, allowed.

7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bikramganj, Rohtas, in connection with Suryapur Police Station Case No. 126 of 2025, subject to the condition laid down under Section 482 (2) of the B.N.S.S.
