The petitioner apprehends his arrest in Kochadhaman P.S. Case No. 216 of 2018, registered for the offences punishable under Section 376 of the Indian Penal Code. Later on section 4 of the POCSO Act was added. It is submitted that petitioner has falsely been implicated in this case. Petitioner has got clean antecedent. From perusal of statement under Section 164 Cr.P.C of victim girl, it appears that there is specific allegation against this petitioner that this petitioner committed rape upon the victim girl.

In view of statement under Section 164 Cr.P.C., I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
