The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Panapur P.S. Case No. 110 of 2019, registered for the offence punishable under sections 420, 406, 467, 468, 471, 506 and 34 of the Indian Penal Code.
As per allegation in the F.I.R., the informant is stated to have given two trucks to one Ravishankar Singh for running the same on rent. It is stated that out of the amount due, a sum of Rs. 15,06,000/- still remains to be paid by Ravishankar Singh to the informant. It is further stated that Ravishankar Singh had also taken away two cheques. He attempted to get a sum of Rs. 2.5 lakh transferred to the account of his father, the
Patna High Court CR. MISC. No.80171 of 2019(4) dt.20-02-2020 2/3 petitioner herein but the cheque was returned due to insufficiency of fund.
It is submitted by learned counsel for the petitioner that from the FIR itself it would be evident that the main allegation is against Ravishankar Singh, who has already been enlarged on anticipatory bail vide order dated 14.11.2019 passed in Cr. Misc. No. 68525 of 2019. The petitioner has been implicated in this case only for the reason that he happens to be the father of the said Ravishankar Singh. On the allegation of the cheque having been misused, it is submitted that from the FIR it would be evident that the same has bounced due to insufficiency of fund and the same has not been returned due to mismatch of signature. The petitioner has no criminal antecedent.
Having heard the counsel for the parties, in the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. He is directed to surrender in the Court below within a period of six weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with
