The petitioner, who is in custody, seeks bail in connection with Mahania P.S. Case No. 321 of 2015 registered for the offence punishable under Section 414/412 of the Indian Penal Code.

Informant is the S.H.O. of Mohania police station, who on receipt of secret information that an ex-criminal Ajit Kumar Chaurasia is standing on Kura village More. He rushed to the spot and arrested the said Ajit Kumar Chaurasia who accepted that he alongwith other accused persons robbed the motorcycle. It has been submitted that petitioner is innocent and has been falsely implicated in this case and he is not named in the FIR. His name has transpired on the confessional statement

Patna High Court Cr.Misc. No.14012 of 2018(3) dt.05-04-2018 2/2 of co-accused Ajit Kumar Chaurasia. It has been further submitted that said Ajit Kumar Chaurasia and other co-accused persons, namely, Manish Singh and Antu Singh have already been granted bail by a co-ordinate Benches of this Court vide order dated 30.01.2016, 11.10.2017 and 12.02.2018 passed in Cr. Misc. No.50691 of 2015, 46849 of 2017 and 8427 of 2018 respectively. It has further been submitted that petitioner is in custody since 19.12.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned court of C.J.M., Kaimur at Bhabhua, in connection with Mahania P.S. Case No. 321 of 2015.
