JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-02-2020 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Chandan P.S. Case No. 102 of 2019 for the offenses under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is in custody since 28.07.2019. The alleged recovery of Rs. 5,000/- cannot be conclusively said to be the looted amount. The petitioner was not named in the FIR yet he has not been put on TIP. The name of the petitioner surfaced on the confessional statement of co-accused Subodh Paswan. Considering the fact that the petitioner was not named in the FIR yet he has not been put on TIP, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named,

Patna High Court CR. MISC. No.70044 of 2019(3) dt.06-02-2020 2/2 be enlarged on bail on furnishing bail bond of Rs. 50,000/-(Fifty Thousand) with two sureties of the like amount each to the satisfaction of the ACJM 1st , Lakhisarai in connection with Chandan P.S. Case No. 102 of 2019.
