The petitioner apprehends his arrest in Panapur P.S. Case No.110 of 2019 registered under Sections 420, 406, 467, 468, 471, 506 and 34 of the Indian Penal Code. The informant alleged that his two trucks were given to the petitioner on the condition to pay Rs.2 lacs per month to the informant but the petitioner did not make payment and parked the trucks of the informant near his house after many months. It is further alleged that the petitioner also took cheque of the informant fraudulently and the same was presented in the account of the father of the petitioner, which was bounced. Learned counsel for the petitioner submits that the informant himself issued cheque of Rs.2,50,000/- towards payment of loan taken from the petitioner and the cheque was
Patna High Court CR. MISC. No.68525 of 2019(2) dt.14-11-2019 2/2 bounced. The petitioner lodged the case much prior to filing of the present F.I.R.
Having considered the facts and the nature of allegation made against the petitioner and the fact that it is a breach of agreement as alleged by the informant, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Saran at Chapra in connection with Panapur P.S. Case No.110 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
