The petitioner has been in custody since 23.10.2014 in connection with Guraru P.S. Case No. 100 of 2017 for the offence registered under Sections 302/34 of the Indian Penal Code. Learned counsel for the petitioner submits that though the petitioner is not named in the first information report, later on, on the basis of confessional statement made before the police by co-accused, namely, Ramesh Singh & Munna Singh, petitioner is facing prosecution. It is further submitted that such statement made before the police, has no evidentiary value and, therefore, the petitioner may be extended the privilege of bail. It is further submitted that similarly situated co-accused person has been granted regular bail vide order dated 06.02.2018 passed in
Patna High Court Cr.Misc. No.8630 of 2018 (3) dt.06-03-2018 Cr. Misc. No. 1360 of 2018.
Considering the aforesaid facts and circumstances of the case and that there is no cogent material in the case diary to implicate the petitioner in connection with the present case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., vth, Gaya in connection with Guraru P.S.
