2. The petitioner seeks bail in connection with Aurangabad Cyber P.S. Case No. 64 of 2025 registered for the offence under Sections 77, 78(2), 79, 351(2), 2(3), 351(4), 352 of BNS and Section 66(E), 67, 67(A), 67(B) of IT Act.

3. The petitioner is named in the F.I.R. and is in custody since 26.07.2025.

4. The allegation against the petitioner is to advance threat to make video of daughter of informant viral on different social media platform in case of failure of payment of Rs. 50,000/-.

Learned counsel appearing on behalf of the petitioner submitted that the alleged threat was advanced through Indian hacker and merely on the basis of suspicion as this petitioner advanced this type of threat earlier to his daughter the present false implication was raised. During investigation nothing transpired which may suggest that this petitioner in actual advanced threat to make video viral on social media platforms. It is also submitted that there is no allegation qua sexual assault or to post any obscene video. While concluding the argument, it is submitted that petitioner is a man of clean antecedent and moreover, investigation of this case is completed, for which charge-sheet has been submitted, as such, there is no chance of tampering with the evidence.

6. Learned APP opposes the prayer of bail.

7. In view of aforesaid factual submission and by taking note of fact as implication of petitioner prima-facie appears out of suspicion due to previous threat of

No.74810 of 2025(2) dt.11-11-2025 3/3 petitioner as alleged, coupled with fact that investigation of this case already completed where petitioner remains in custody since 26.07.2025, accordingly petitioner above named, is directed to be released on bail in connection with Aurangabad Cyber P.S. Case No. 64 of 2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge II, Aurangabad /concerned court, subject to the conditions as mentioned under Section 480(3) of BNSS.
