JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-03-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 7.4.2017 passed in Cr.Misc.No.6176 of 2017 with direction to learned trial court to expedite the trial and conclude the same within a period of nine months. Submission of learned counsel for the petitioner is that petitioner is in custody since 26.10.2016 and trial has not been concluded as yet.

Heard learned APP also.

Having heard both sides and on perusal of report it appears that trial court has assured to conclude the trial within a further period of three months, I am not inclined to grant bail to the petitioner at this stage.

However, learned trial court is directed to conclude the

Patna High Court Cr.Misc. No.7852 of 2018 (3) dt.21-03-2018 2/2 trial within a further period of three months and if trial is not concluded within the said period without any laches on the part of accused, learned trial court shall release the petitioner on bail to its own satisfaction.

With the above observation, this application is disposed of.
