Petitioner, who is the husband of the deceased, is an accused in a case registered for offence under sections 304B/34 IPC.
Learned counsel for the petitioner submits that there was love marriage between the petitioner and the victim and the petitioner has falsely been implicated in this case. It appears from the investigation and the medical evidence that the doctors have found smell of Kerosene oil and the victim died of burn injury. Petitioner is in custody since 23.4.2017.
Learned counsel for the informant opposes the prayer for bail.
Petitioner being husband has the prime responsibility of
Patna High Court Cr.Misc. No.12711 of 2018 (3) dt.06-04-2018 the victim. Considering the gravity of allegation, I am not inclined to grant bail to the petitioner for the present. The prayer for bail of the petitioner is rejected.
