2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 379 of the Indian Penal Code.

3. The case of the prosecution is that Honda Dream Yug motorcycle of the informant was being stolen by the unknown miscreants. Hence, the present FIR.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that the petitioner is not named in the FIR rather his name has surfaced on the basis of the confessional statement of one co-accused, namely, Munna Kumar @ Munna Kumar Singh. It is also submitted that there is enmity between Munna Kumar @ Munna Kumar Singh and the petitioner herein and the cases in which

It is further submitted that nothing has been recovered from the conscious possession of the petitioner and no T.I.P has been conducted. Further submission is that co-accused, namely Munna Kumar @ Munna Kumar Singh, on whose confessional statement name of the petitioner has surfaced, has since been extended the privilege of bail vide order dated 14.02.2025 passed in Cr. Misc. No. 80231 of 2024 and its analogous cases. Moreover, the petitioner is languishing in judicial custody since 02.08.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sarai P.S. Case No. 52 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Vaishali at Hajipur.
