Petitioner seeks bail in a case registered for the offences punishable under Sections 363,366(A)/34 of the Indian Penal Code as well as Section 8 of POCSO Act. The statement of the victim girl recorded under Section 164 Cr.P.C. vide Annexure-2 would reveal that she had not alleged any kidnapping by anyone rather has stated that she had voluntarily gone with the petitioner. Considering the statement of the victim girl, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection
Patna High Court Cr.Misc. No.19822 of 2018 (2) dt.11-04-2018 with Bihra Police Station Case No.4 of 2018 POCSO 10 of 2018, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
