JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-12-2019 Petitioner seeks regular bail in connection with Galgalia P. S. Case No. 43 of 2019, registered for the offences punishable under Sections 461, 379 and 34 of IPC. As per F.I.R. there was a theft of Rs.9,21,630/- in the State Bank of India, branch Churlihat. F.I.R. was lodged against unknown, later on, confessional statement has been recorded, in which, petitioner was named. It further appears from the impugned order that there was recovery of Rs.25000/- from one co-accused Afzal Ahmad.

Submission of the learned counsel for the petitioner is that the other accused person on his confessional statement, he has been made accused, has been granted by a Co-ordinate Bench of this Court, vide order dated 25.10.209 passed in Criminal Misc. No. 62452 of 2019 with Criminal Misc. No.

Patna High Court CR. MISC. No.70152 of 2019(2) dt.11-12-2019 2/2 62570 of 2019. He is in custody for three months. Charge sheet has been submitted, as such, there is no chance of tampering with the evidence.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of Shri D.K. Pandey, learned Judicial Magistrate, 1st Class, Kishanganj, in connection with Galgalia P. S. Case No. 43 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
