The petitioner seeks bail in connection with G.O. Case no. 59 of 2018 registered under Section 30 (a) of Bihar Prohibition & Excise Act-2016.

146 lts. of country made liquor is said to have been recovered from the roof of the bus and as per the statement of conductor of the bus, the petitioner happens to be the owner of the said liquor.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. He has no concern with the seized liquor. As a matter of fact, he was travelling in the

No.21699 of 2018(2) dt.17-04-2018 2/2 said bus and has been falsely implicated in the case by the conductor who himself was the owner of the said liquor simply to pass the buck upon the petitioner. He has no criminal antecedent. He has been languishing in custody since 04.02.2018.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-II-cum-Spl. Judge, Nawada in connection with G.O. Case no. 59 of 2018.
