The petitioner is languishing in custody for the offences punishable under Sections 387/307/34 of the Indian Penal Code and Section 27 of the Arms Act.
According to FIR, on non-fulfillment of demand of ransom, on the order of this petitioner two others fired at the informant with intent to commit murder. However, no injury was caused to the informant as the informant and others escaped on the vehicle.
Submission is that the petitioner is in custody since 08.12.2015. The impugned order does not reveal that any other material was there against the petitioner.
Considering the nature of allegation and the period
Patna High Court Cr.Misc. No.26810 of 2018 (2) dt.02-05-2018 P2/ already undergone, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Khaira P.S. Case No.167 of 2014, with condition that both the bailors shall be the resident of territorial jurisdiction of the learned Court-below and the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the petitioner.
