Mr.Chandra Sen Prasad Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 22-03-2023 Heard learned counsel for the petitioner, learned APP for the State as well as learned counsel appearing on behalf of the informant.

The petitioner apprehends his arrest in connection with Sangrampur P.S. Case No.146 of 2022, registered for the offences punishable under Sections 302, 120(B) and 34 of the Indian Penal Code as well as under Section 27 of the Arms Act. The petitioner and other co-accused persons are said to have killed the son of the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner has got no criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that the petitioner is made accused in the present case

Patna High Court CR. MISC. No.722 of 2023(2) dt.22-03-2023 2/2 on the statement of the deceased in the hospital. It is submitted that the informant in his re-statement has not taken the name of the petitioner. It is further submitted that the informant in his restatement took the names of Somnath Singh and Rahul Singh. The learned APP for the State opposed the prayer for grant of anticipatory bail to the petitioner. Considering the nature of offence, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for grant of anticipatory bail to the petitioner is hereby rejected.
